Media and free speech is one of those things that ‘law’ has a hard time dealing with. Things that are in the realm of mind. I guess, that is probably good, since law, especially the criminal law, should never regulate the mind. More importantly it should not too close to regulating the flow of information. Thus, we do not need “harm” rules about speech/flow of info, we need “risk” rules. It does not matter if someone’s speech is actually chilled, it just matters that there is a risk. Just as we accept that that ten guilty men go free for one innocent man not to be punished, we should likely accept ten people’s crimes to be furthered, for one person’s right to speak.

It is not so hard to reconcile morality and professional ethics as it might seem. Depending one’s perception of what the elements of morality are, it is simple to compare those elements to the elements of a given profession’s ethics. Where they conflict, a moral person will not necessarily be able to be ethical. Of course, an ethical person in that profession would not need to be moral.
To the degree that a profession includes many ethics that are immoral, it is an immoral profession. Thus, trying to choose moral creatures for an immoral profession will never work. They will end up being unprofessional or violating the ethics. To the degree that a profession includes ethics that are also moral, moral people will be the best at it.
